No Surprises Act: Latest Updates, Pitfalls and Possible Future Changes

Although the No Surprises Act, which became effective on January 1, 2022, was meant to create some level of predictability for patients, providers, and insurance companies, alike, it has often led to more confusion and chaos in terms of reimbursement for medical claims. Consequently, to bring some order back to your revenue cycle, it is imperative for providers, facilities, and revenue cycle professionals to have a deep understanding of the rules and requirements of the No Surprises Act, as well as to have foresight into how this law and its underlying rules continue to evolve.

During this webinar, the speaker will provide an overview of the No Surprises Act as a whole, including required disclosures, options for maximizing reimbursement (including strategies and considerations that should be taken into account), and the requirements that must be satisfied in order to utilize those options. In addition, and as related to such subtopics, the speaker will discuss common pitfalls to which providers, facilities, and professionals fall victim, as well as how those pitfalls can be avoided or overcome.

Finally, in determining which option for maximizing reimbursements is best (i.e., balance billing patients through the notice and consent option, or seeking additional sums from the applicable payor/ insurance company via the independent dispute resolution process), the speaker will discuss concerns raised regarding various aspects of the No Surprises Act discussed during the September 2023 meeting of the United States House of Representatives Ways and Means Committee. These concerns and aspects related to, among other topics, whether the independent dispute resolution process has worked fairly, in accordance with timelines set forth in the No Surprises Act and/ or its underlying regulations, and in line with the intent of the law, itself.

The hope is that with this information, audience members will be able to ensure that their respective practices, facilities, professionals, and clients are compliant and able to maintain and maximize an efficient revenue cycle.

Presenter Biography:

An attorney licensed in New York, New Jersey, and Arizona, Mr. Neuner has spent the vast majority of his professional career in the healthcare sector since graduating from Brooklyn Law School.

Prior to joining The Patriot Group at the start of 2021, Mr. Neuner simultaneously served as General Counsel, Director of Mergers & Acquisitions, and as the interim Chief Financial Officer for a medical management services firm that subsequently developed into a sizeable primary care practice in Arizona. During this five-plus year tenure, Mr. Neuner served as the right hand of that company’s owner and Chief Executive Officer. In this regard, Mr. Neuner played an integral role in that organization’s exponential growth, while ensuring that the operations ran efficiently and compliantly.

Mr. Neuner relies on this past experience, as well as his previous litigation experience, in order to promote the compliance The Patriot Group’s clients. As part of his responsibilities, Mr. Neuner defends against audits and recoupments/ refund demands, provides guidance on carrier policies and applicable laws/ regulations (including the No Surprises Act and other surprise billing laws), prepares appeals for unpaid or underpaid claims, and represents clients in surprise billing disputes.
